En Hispanoamérica la defensa del derecho de autor puede ser visto como inusual e incluso exótico, debido a nuestra historia de proveedores de materias primas, donde el talento académico nos ha sido de poca exigencia. Sin embargo, en un lento proceso de edificación del sistema educativo, la legitimidad de los títulos adquiridos, así como la idoneidad de las publicaciones cobran mayor importancia. La exigencia de idoneidad docente y legitimidad de los títulos académicos constituye un desafío en la construcción de conciencia colectiva, que revertirá en mejora de nuestra responsabilidad ciudadana y defensa de educación de calidad. En ese contexto deseamos que nuestras palabras sean recibidas.

En su misiva de junio 02 de 2020, manifiestan que en nuestros planteamientos no existen aspectos novedosos, sin embargo, tenemos una lectura diferente, en relación con los hechos, aspectos legales y normativos, que solicitamos sean tenidos en cuenta.

El autor de la tesis doctoral, Jonathan Malagón, contó con todas las garantías institucionales para lograr una publicación idónea, entre ellas, la asesoría de su director y la revisión de los evaluadores. Sin embargo, en la tesis se observa que en cada uno de los cuatro capítulos el autor omitió referenciar e incluir en la bibliografía las cuatro tesis de maestría, publicadas de manera previa en Colombia. Se infiere que también omitió suministrar esa información al director y los evaluadores porque, de haber sido informados, estos debieron indicar el ineludible cumplimiento de la norma de citas.

La magnitud de párrafos copiados sin cita es por decir lo menos, desproporcionada. Nosotros encontramos que se trata del 83.65% del contenido de la tesis doctoral, cuya procedencia son las cuatro tesis de maestría que ya habían sido publicadas en Colombia.

Las cuatro tesis de maestría fueron publicadas por tres universidades. En cada una de las tesis se encuentran identificados con claridad sus autores y fecha de publicación, por ello no es cierto que no es posible establecer la autoría de los contenidos. Además, los derechos morales de autor son intransferibles e irrenunciables, eso explica que por ningún proceder un director de tesis se puede apropiar de los contenidos de sus discípulos y presentarlos como propios. Afirmar que se desconoce la autoría de esos contenidos, es contrario a las evidencias documentales y a la Ley de derechos de autor.

A nivel normativo, no existe antecedente de solicitud de corrección de una tesis doctoral en aspectos relacionados con su originalidad, debido a que esta es su condición connatural. ¿Cuál norma de la Universidad de Tilburg permite realizar corrección de una tesis doctoral? Además, de manera práctica, es imposible “corregir” 180 párrafos y 30 tablas y cuadros, en 87 de 104 páginas de contenido efectivo de la tesis doctoral “Four essays on central banking in Latin America under balance of payments dominance” (Malagón González, Tilburg, 2017).

In Hispano America, copyright can be seen as unusual and even exotic, because of our history of consumers of researches, consequently our academic talent has been of little demand. However, in a slow process of building the educational system, the legitimacy of acquired titles and the suitability of publications become an important asset. The demand for teaching and legitimacy of academic qualifications is a challenge in building collective consciousness, which will improve our citizens’ responsibility looking for better education. We wish you receive our word in that context

In your letter from June 2020 mission, state that in our approaches there are not novel aspects, however, we have a different reading, in relation to the facts, legal and regulatory aspects, which we ask to be taken into account.

The author of the doctoral thesis, Jonathan Malagon, had all the institutional guarantees to achieve a suitable publication, including the advice of his director and the review of evaluators. However, the thesis indicates that in each of the four chapters, the author omitted to refer the sources which should be cited with appropriate bibliographies and references, including the four master thesis, previously published in Colombia. It is inferred that he also failed to provide that information to the board the directors and the evaluators because, if informed, they had to indicate the inescapable compliance with the proper way to cite the sources with the appropriate bibliographies and references.

The magnitude of paragraphs copied without proper citation is to say the least, disproportionate.  We found the 83.65% of the content of the doctoral thesis, comes from these four master’s thesis that had been already published in Colombia.

The four master’s theses were published by three universities.  In each of the theses are clearly identified the authors and date of publication, so it is not true that it is not possible to establish the authorship of the contents.  In addition, the moral rights of copyright are non-transferable and indispensable, this explains that by no means a thesis director can appropriate the contents of his disciples and present them as his own.  To claim that the authorship of such content is unknown is contrary to documentary evidence and the Copyright Act.

At the normative level, there is no history of requesting correction of a doctoral thesis in aspects related to its originality, because this is a connatural condition.  Which standard of the University of Tilburg allows correction of a doctoral thesis?  In addition, in a practical way, it is impossible to «correct» 180 paragraphs and 30 tables and tables, in 87 of 104 pages of effective content of the doctoral thesis «Four essays on central banking in Latin America under balance of dominance» (Malagón González, Tilburg, 2017).

We request reports on these complaints, procedures and decisions to the Ministry of Education of the Netherlands, the European Association for Quality Assurance in Higher Education ENQA, European Association of Institutions in Higher Education-EURASHE- and European Students’ Union
